Philippines 12% VAT on digital ads
Republic Act 12023 brought digital services, including online advertising, into Philippine VAT. Nonresident digital service providers with more than PHP 3 million in turnover had to register by 2 April 2025 and have charged 12% VAT since 1 June 2025. For advertisers buying from global platforms, budgets now need a clear rule on whether figures are gross or net of VAT, and finance teams need the right invoices to claim input VAT where they can.

What the law does
Secondary source
Republic Act 12023 amended the Tax Code to impose VAT on digital services. Revenue Regulations No. 3-2025 took effect on 1 February 2025. Resident providers charged VAT from then; nonresident providers from 1 June 2025. Consumption in the Philippines is established from payment, residency, IP address or other reliable information.
Registration and returns
Documented: official source
Nonresident providers above PHP 3 million in turnover registered through the VAT on Digital Services portal and file a dedicated return, BIR Form 2550-DS. They may appoint a local third-party representative for notices and filings.
Budgeting after the change
FOCUSADS view
| Budget line | Write it as | Why |
|---|---|---|
| Media budget | Net of VAT, plus 12% VAT shown separately | Platform spend caps are set net of tax |
| Client approval | Gross total including VAT | Matches the invoice the client pays |
| Cross-channel comparison | Same tax basis for every channel | Local media may already include VAT |
Where we see opportunity
FOCUSADS view
The VAT puts global platforms and local media on a more even tax footing for Philippine buyers. That makes local channels, from marketplace ads to out-of-home in Metro Manila, worth re-pricing against social and search on the same basis.
