Website terms of use

The rules for using the FOCUSADS.si website, the plan builder and the client application.

Current version, effective 18 October 2026. If we change this document we publish the new version here with its date.

1. About these terms

These terms govern your use of focusads.si, focusads.ai and the applications hosted on them (together, the "Site"). The Site is operated by THEFOCUS LTD ("FOCUSADS", "we", "us"). Paid services are governed by our Service terms and the order form or accepted quote that refers to them. If these terms and the Service terms conflict, the Service terms apply to paid services.

By using the Site you accept these terms. If you use the Site on behalf of an organisation, you confirm that you are authorised to accept them for that organisation.

2. Business use only

The Site and our services are for businesses, sole traders acting in the course of their business, public bodies and charities. We do not contract with consumers. If you are acting wholly or mainly outside your trade, business, craft or profession, please do not create an account, request a plan or accept a quote. If we find that a contract has been made with a consumer, we will tell you, end it without charge for any period not yet delivered and refund fees paid for that period.

3. Information on the Site

Insights, channel guidance, market information, budget ranges and plan outputs from Build Your Plan are general commercial information prepared with care from the sources and dates shown. They are not a promise of results and not legal, tax or financial advice. Advertising performance depends on factors outside our control, including platform auctions and policies, market conditions, your offer and your sales process. We do not guarantee any return on ad spend, lead volume, revenue or ranking.

Prices shown on the Site include VAT. A price becomes binding only when it appears in an accepted quote or order form. If a price on the Site is obviously wrong, we may correct it before a contract is made.

4. Accounts and security

Client accounts require multi-factor authentication. Keep your credentials and authenticator device secure, do not share accounts, and tell us promptly through the contact form if you think an account is compromised.

We may suspend access to protect the Site, our clients or third parties, for example after repeated failed sign-in attempts or suspected misuse. We will tell you why unless the law or a security reason prevents it.

5. Acceptable use

You must follow our Acceptable use policy. In particular you must not probe, scan or test the vulnerability of the Site outside our responsible disclosure process, try to access another organisation's data, introduce malware, or upload content you have no right to share.

6. Intellectual property

We own or license the Site, its software, design, text, data compilations, scoring and planning methods, and the FOCUSADS names and A emblem. You may view and print pages for your internal business use. You must not copy, scrape, systematically extract, resell, frame or build competing products or datasets from the Site or its outputs without our written permission. This includes using automated tools or AI training pipelines to collect content from the Site. Your own data stays yours; see the Service terms and the Data processing addendum.

7. Availability and changes to the Site

We aim to keep the Site available but do not promise uninterrupted access. We may change, suspend or withdraw any part of the free Site at any time.

9. Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under the law of England and Wales.

Subject to that, we are not liable for loss of profit, revenue, business, goodwill, data or anticipated savings, or for indirect or consequential loss, arising from use of the free parts of the Site, and our total liability for the free parts of the Site is limited to £100. We consider these limits reasonable for a free service under the Unfair Contract Terms Act 1977. Liability for paid services is set out in the Service terms.

10. Changes to these terms

We may update these terms. The "last updated" date shows the current version. We tell signed-in users about material changes in the application before they take effect.

11. Law and jurisdiction

These terms and any dispute or claim arising from them or from your use of the Site, including non-contractual disputes, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
